Here is some information about the personal data we collect when you use our website. Personal data means any data relating to you personally, such as your name, address, email address or user behaviour.

When you contact us by email or using a contact form, we will store the data provided by you (your email address, your name and your telephone number, if applicable) to answer your questions. We erase the data collected in this context after their storage is no longer required, or limit processing if there are statutory retention obligations.

II. Provision of the website and creation of log files

1. Description and scope of data processing

Whenever our website is accessed, our system automatically collects data and information from the computer system accessing it. The following data are collected:

These data are stored in our system’s log files. These data are not stored in connection with any other personal data concerning the user.

2. Legal basis and purpose

The legal basis for the temporary storage of data and log files is point (f) of Art. 6(1) of the GDPR.

Log files are stored so as to ensure the functionality of the website. Furthermore, these data are used by us to optimise our website and to ensure the security of our information technology systems. In this context, these data may be analysed for marketing purposes.

These purposes constitute our legitimate interest in processing the data in accordance with point (f) of Art. 6(1) of the GDPR.

3. Storage period

The data will be erased as soon as they are no longer required for the purpose for which they were collected. In the case of collecting data for the purpose of providing the website, this will be at the end of each session.

In the case of storing data in log files this will be no later than after seven days. A storage beyond this period of time is possible.

4. Possibility of objection and removal

The collection of data for the purposes of providing the website and the storage of data in log files is strictly necessary for the operation of the website. Consequently it is not possible for the user to object to this processing.

III. Cookies, analytics tools and plugins

The legal basis for processing personal data by using cookies is point (f) of Art. 6(1) of the GDPR.

Description and scope of data processing

Our website uses cookies. Cookies are text files stored in the web browser or stored by the web browser on the user’s computer system. When a user accesses a website, a cookie can be set on the user’s operating system. This cookie will contain a unique character sequence making it possible to reidentify the browser the next time it accesses the website.

We use cookies to make our website more user-friendly. Some elements of our website make it necessary for the browser accessing the site being identified even after a change of website. Which data are collected and processed?

The following data may be collected: Browser, operating system, IP (internet protocol) address, language, internet address of the website, time and date of access, volume of data and browser plugins. The user data collected are pseudonymised by technical means. This means that while the data still refers to a given user accessing the site, it is not possible to determine the user’s identity. These data are not stored in connection with other personal data concerning the user.

Unless otherwise stated, the controller for the data processing in connection with tools is the provider of the relevant tool. The providers of tools may pass on information to third parties for the purposes stated above.

Most of the cookies we use are ‘session cookies’. They are automatically deleted at the end of your visit. Other cookies remain stored on your device until you delete them. These cookies allows us to recognise your browser when you next visit.

You can configure your browser such that you are informed when cookies are set and allow cookies only in individual cases, refuse cookies in certain cases or generally and activate the automatic deletion of cookies when the browser is closed. If cookies are deactivated, the functionality of this website may be limited.

Cookies necessary for the performance of electronic communications or for the provision of certain functions requested by you (e.g., shopping basket) are stored on the basis of point (f) of Art. 6(1) of the GDPR. The owner of the website has a legitimate interest in storing cookies for the optimal provision of its services free of technical errors. 1. Google Analytics / Universal Analytics

This website uses Google Analytics with Universal Analytics functions, a web analytics service provided by Google Inc. (‘Google’).

Google Analytics uses cookies. The information generated by the cookie concerning your use of this website is usually transmitted to a Google server in the US and stored there. In the event that IP anonymisation is activated on this website, your IP address will be shortened beforehand by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the US and shortened there. On behalf of the operator of this website, Google will use this information to analyse your use of the website, to compile reports on website activities and to provide other services relating to the use of the website and the internet to the website operator.

The IP address transmitted by your browser in connection with Google Analytics will not be merged with any other Google data.

You can prevent the storage of such cookies by changing the settings of your browser software accordingly; however, please note that, in this case, you may not be able to make full use of all the functions of this website. This website uses Google Analytics with the “_anonymizeIp()” extension. This means that IP addresses are truncated before being processed further, making it impossible to link them to a particular individual. Where the data collected about you are linked to a particular individual, that link is thereby excluded and the personal data are erased immediately.

We use Google Analytics to analyse how our website is used and to be able to improve it regularly. The statistics obtained allow us to improve our service and to make it more interesting to you as a user. For those exceptional cases where personal data are transmitted to the US, Google has agreed to comply with the EU-US Privacy Shield.

The legal basis for using Google Analytics is point (f) of Art. 6(1) of the GDPR.

The storage period for the data collected is: 14 months

2. Universal Analytics

In addition, we also use the Universal Analytics functionality. This allows us to collect and analyse socio-demographic user data by means of a Google ID (if applicable) and from cookies generated when Google ads are displayed (DoubleClick). Where a Google ID is being used, we also collect these data across devices (e.g., if users use both a smartphone and a PC). You can find further information on this here and here.

If you have deactivated Google Analytics by using the browser plugin or the opt-out link (see above), this means that Universal Analytics is also deactivated on the device where Google Analytics is deactivated – but not on other devices.

 

IV. Registering on our website, newsletter

Registering on our website

Data subjects have the option to register on the website of the data controller by submitting personal data. The personal data transmitted to the data controller depend on the input mask used for registration. The personal data entered by the data subject will only be used for internal processing by the data controller and are collected and stored for their own purposes only. The data controller may cause the data to be passed on to one or several service providers such as a parcel service, who will also only use the personal data for internal processing that is deemed part of the processing done by the data controller.

By registering on the website of the data controller, the IP address allocated to the data subject by their internet service provider (ISP) and the date and time of registration will also be stored. These data are stored to prevent the misuse of our services and to have these data available, where necessary, to help investigate any crimes committed. To that extent, storing these data is necessary for safeguarding the data controller. In general, these data are not passed on to third parties, unless there is a statutory requirement to pass on the data or the data are required for law enforcement purposes.

The purpose of registering a data subject voluntarily sharing their personal data is for the data controller to be able to provide contents or services to the data subject which by their nature can only be provided to registered users. Registered users have the option, at any time, to amend the personal data submitted when registering or to have them permanently erased from the database held by the data controller.

The data controller shall, at any time and on request, provide information to any data subject as to which personal data concerning the data subject have been stored. In addition, the data controller shall rectify or erase personal data when requested or warned to do so by the data subject, unless statutory retention obligations dictate otherwise. All employers of the data controller shall be available as contact persons to the data subject in this respect.

Subscribing to our newsletter

Our website offers users the opportunity to subscribe to our company’s newsletter. The personal data transmitted to the data controller when subscribing to the newsletter depend on the input mask used for this purpose.

Fendt-Caravan GmbH informs its customers and business partners of any company offers at regular intervals by means of a newsletter. As a matter of principle, our company’s newsletter can only be received by a data subject if (1) the data subject has a valid email address and (2) the data subject subscribes to the newsletter. For legal reasons, as part of the double opt-in process, a confirmation email is sent to the data subject’s email address when it is first registered for subscribing to the newsletter. The purpose of this confirmation email is to verify whether the owner of the email address has authorised the subscription to the newsletter as a data subject.

The personal data collected in the context of a newsletter subscription will only be used for sending out the newsletter. In addition, subscribers to the newsletter may be notified by email where this is necessary for operating the newsletter service or a registration for this purpose is required, as may be the case in case of changes to the newsletter service or of a change to the technical conditions. The personal data collected in respect of the newsletter service will not be passed on to third parties. Data subjects may cancel their subscription to our newsletter at any time. The consent given by data subjects to the storage of their personal data for sending out the newsletter may be withdrawn at any time. Each newsletter contains a link for the purpose of withdrawing that consent. It is also possible to unsubscribe from the newsletter directly on the data controller’s website or to notify the data controller of this in any other way.

Newsletter tracking

Our newsletters contain so-called tracking pixels. A tracking pixel is a miniature graphics file embedded in emails sent in HTML format allowing the recording and analysis of a log file. This makes possible the statistical analysis of the success or failure of online marketing campaigns. Using the embedded tracking pixel, we can see whether and when an email was opened by a data subject and which links contained in the email were accessed by the data subject.

Such personal data collected via the tracking pixels contained in newsletters will be stored and analysed by the data controller in order to optimise the dispatch of the newsletter and to better adapt the contents of future newsletters to the interests of the data subject. These personal data will not be passed on to third parties. Data subjects have the right, at any time, to withdraw their specific consent to this given in the double opt-in process. When this consent is withdrawn, these personal data will be erased by the data controller. Any unsubscription from the newsletter will be deemed a withdrawal of consent by Fendt-Caravan GmbH as a matter of course.

 

V. Rights of data subjects

If your personal data are processed, you are a data subject within the meaning of the GDPR and you have the following rights vis-à-vis the controller:

1.       The right of access pursuant to Art. 15(1) and (2) of the GDPR;

2.       The right to rectification pursuant to Art. 16 of the GDPR;

3.       The right to erasure pursuant to Art. 17 of the GDPR;

4.       The right to restriction of processing pursuant to Art. 18 of the GDPR;

5.       The right to data portability pursuant to Art. 20 of the GDPR;

6.       The right to object pursuant to Art. 21 of the GDPR;

7.       The right to withdraw your consent at any time, pursuant to Art. 7(3) of the GDPR

          If you make use of your right to withdraw your consent, please note that such withdrawal shall only have effect ex nunc, i.e., from the time of the withdrawal onwards.

8.       The right to lodge a complaint pursuant to Art. 77 of the GDPR

The competent supervisory authority is the Baden-Württemberg state commissioner for data protection and freedom of information.

VI. Amendments to this privacy policy

Fendt-Caravan GmbH reserves the right to amend this privacy policy at any time while complying with applicable data protection provisions.
